I’ve Been Denied Social Security Disability in the State of Utah.
 
 

 
Now What?
 
If your claim has been denied you may wondering what to do next. Many people drop out because they become discouraged and feel like the Social Security Administration doesn’t take their disability seriously. But, they don’t know that most disability claims are denied at the initial level. To win, you need to be prepared to appeal the claim several times. Denial should also be a signal that you need an experienced Utah attorney.
 
 
 If you disagree with SSA’s decision (and you should), you have the right to ask SSA to look at your application again. A more detailed discussion of your rights to appeal is available on our claim process page. The notice you receive from the SSA indicating you don’t qualify, will also explain how to appeal the decision and the time period in which you must make the request.
 
 
 

The notice will typically explain that if SSA decided you did not qualify:

  • You can appeal the decision online because you were not considered disabled under the rules
  • As part of the appeal you need to fill out the online disability report. It will ask you for updated information about your medical condition and any treatments, tests, or doctor visits since the SSA made the decision.
  • If you were denied for non-medical reasons, you should contact your local Social Security office to request the review.
  • You also may call SSA’s toll-free number, 1-800-772-1213, to request an appeal. People who are deaf or hard of hearing can call the toll-free TTY number, 1-800-325-0778.
  • People who don’t have enough work credits to be eligible for Social Security Disability benefits may possibly qualify for Supplemental Security Income if they have limited income and resources.

These are good steps to follow. You only have a limited time to appeal after a denial, so don’t waste any time. You can increase your chances of being awarded SSDI or SSI benefits by doing the following:

  • Hire a disability lawyer. He can guide you through the process and help you sort through all your forms for the next appeal.
  • Find out if your physician will support your disability case. If so, your doctor needs to complete a Residual Functional Capacity form detailing your symptoms and how they impact your ability to function.
  • Submit copies of your medical records (including the most recent updates) when you apply and each time you appeal.
  • Cooperate fully with the disability claims examiner working on your case. This includes responding promptly to letters and notices as well as going to any consultative medical exams scheduled by Disability Determination Services (DDS).
  • Don’t let important deadlines lapse on your disability claim.
