“Social Security disability benefits” refers to the Social Security Disability Insurance program, or SSDI. The Social Security Administration, or SSA, runs this program. In order to receive disability benefits with respiratory failure, you must meet the SSA’s requirements.

To help you understand your case, we will break down the requirements for respiratory failure benefits. In order to qualify, your condition must meet the following guidelines.

  • You must experience respiratory failure, due to any underlying respiratory disorder

You can qualify for benefits if any type of chronic respiratory disorder causes your failure. However, the requirements change slightly if you have cystic fibrosis. We will explain these changes later on this page.

  • You must receive invasive or noninvasive ventilation treatment

To be eligible for disability benefits, you must receive invasive or noninvasive ventilation treatment (or both). These treatments utilize machines to help you breathe. Invasive mechanical ventilation involves placing a tube in the trachea. Noninvasive ventilation uses a BiPAP machine to deliver air through a face mask.

Your ventilation treatment must last at least 48 hours. If you are receiving the treatment after a surgery, it must last at least 72 hours.

  • You must receive these ventilations twice within 12 months

The SSA states that you must receive a 48-hour ventilation treatment (or 72-hour after surgery) twice within 12 months. In addition, each treatment must be at least 30 days apart from the other.

If you have cystic fibrosis, you only need to receive this type of treatment once if you experience respiratory failure.

Applying for Social Security Disability Benefits

You can apply for Social Security disability benefits in two ways. You can apply online, or in person at a local Social Security office. If you decide to work with us, we will take care of a large part of the application process.

If you are interested in applying for disability benefits online, there are some simple steps to follow. Just do the following four things to submit your application.

  2. Complete the Disability Benefit Application
  3. Answer questions on the Adult Disability Report
  4. Complete the Authorization to Disclose Information form, then deliver it to your local Social Security office (by mail or in person)
